K-1 Visa Eligibility & the Petition Process

Who Qualifies

The petitioner must be a U.S. citizen. Lawful permanent residents aren’t eligible to file a K-1 petition. Both parties must be legally free to marry, meaning any prior marriages must have ended through divorce, annulment, or the death of a spouse. The couple must also have met in person at least once within the two years before filing, though limited exemptions exist for extreme hardship or certain cultural and religious customs.

Steps From Petition to Entry

The process begins when the U.S. citizen files Form I-129F, Petition for Alien Fiancé(e), with USCIS. The filing includes proof of citizenship, evidence of the relationship, and documentation of the in-person meeting. After USCIS approves the petition, it goes to the National Visa Center, which assigns a case number and forwards the file to the U.S. consulate in the foreign fiancé’s country.

The foreign fiancé then completes a medical examination with an approved physician, submits the DS-160 application form, and attends a consular interview. If the visa is issued, they may travel to the United States. From the date of entry, the couple has 90 days to marry. If marriage doesn’t take place within that window, the visa expires and the foreign national must depart. Unmarried children under 21 may accompany or follow on K-2 visas.
